January 23, 1978 Page 8 <br />FESTIVITIES COMMISSION ORDINANCE <br />MSP (Pickar - Ziebarth) to adopt Ordinance #273, adopting the Festivities Commission <br />as an official commission of Mounds View. 5 ayes <br />MID- AMERICAN AUTO, INC. - CONDITIONAL USE PERMIT AND LICENSE <br />Administrator Achen reported that Mid - American Auto has created three additional <br />customer parking spaces and converted five previous customer parking spaces to <br />show parking, and stated that the Staff had drawn up a plan which showed considera- <br />bly less parking spaces than Mid- American was showing. <br />Mr. Getz, owner of Mid- American Auto stated that the parking spaces he had drawn <br />in were 10.5' wide, which was wider than the required 9.5'. <br />Mayor Pickar asked if the parking plan drawn up by the City was acceptable to <br />Mr. Getz. Mr. Getz replied that the 37 spaces would be acceptable but that he felt <br />he could fit many more in. Mayor Pickar questioned if the one area would be paved <br />to allow for more parking. Mr. Getz replied that he would have it paved in the <br />Spring. <br />Councilmember Baumgartner questioned what was being planned for the junk and so <br />forth. Mr. Getz questioned how long he would have to get the junk out. He also <br />stated that he had been under the impression that what was being done inside the <br />building would not bother others. <br />Mayor Pickar asked Mr. Getz how long he would need to get the junk moved out. Mr. <br />Getz replied that he would like to wait until warm weather. Mayor Pickar also <br />questioned if the garbage truck had a canvas over it. Mr. Getz replied that it <br />did. Mayor Pickar asked if 60 days would be ample time for Mr. Getz to remove <br />the junk. <br />Councilmember Baumgartner stated that he did not feel the City should be asking <br />Mr. Getz how long he wanted, that instead the City should be setting a time limit <br />with which he must comply. He also pointed out that if Mr. Getz was able to get <br />the junk in during the winter, he could also get it out during the winter. <br />MSP (Pickar- Rowley) to direct Mid- American Auto, Inc. to clean up the area, removing <br />the items as indicated in the report to the Council by April 1, 1978 and that <br />Mid - American Auto, Inc. comform to the parking plan as directed by the City on the <br />display map, and that the major repair of cars not be allowed, and that the use be <br />limited to a maximum of 37 cars, with 10 spaces marked for customer parking and <br />that the area presently used for parking on the grass be paved no later than <br />July 1, 1978. <br />Mr. Getz asked if the limit of 37 cars included the area to be paved. Mayor <br />Pickar replied that it did. <br />Mr. Getz also stated that he would like a one month extension for removing the <br />junk. Councilmember Rowley recommended that Mr. Getz remove all possible junk now <br />and that if he ran into problems with any particular items, that he contact the <br />City at that time for an extension. <br />5 ayes <br />
