January 23, 1978 Page 9 <br />LAUNCHING PAD SUPPER CLUB <br />Mayor Pickar reported that the Launching Pad has requested the Council to release <br />the remaining $500 the city holds in escrow as security for the licensing agreement <br />executed last June. Mr. Hartinger should pay for the $530.30 in accumulated admini- <br />strative charges regarding the remodelling requirements of the agreement. <br />Attorney Meyers recommended that Council declare a portion of the escrow to be <br />forfeited for non - compliance with Section 7 of the agreement and that Mr. Hartinger <br />pay the city's investigation and legal costs related to the topless dancing incident, <br />which amounted to approximately $190. Attorney Meyers also stated that at the <br />second pre -trial hearing he moved that the charges be dismissed against Mr. Hartinger <br />as his defense was saying that the owner was not on the premises at the time of the <br />incident, and recommended that it be deemed a violation of the ordinance and thus <br />was a violation of the contract he had entered into with the city. <br />MSP ( Pickar- Hodges) motion that the Launching Pad be refused the return of $500 <br />that still remains in escrow and that they be billed for the $30.30 for the <br />total amount of administrative costs that the Staff incurred to fulfill the <br />agreement with the city. <br />Attorney Meyers also pointed out that Mr. Hartinger had asked the Police Chief if <br />the contest he planned on holding would be a violation, and that the Police Chief <br />had consulted him and that he stated it would not be a violation but might be <br />asking for trouble, which was conveyed back to Mr. Hartinger. <br />Councilmember Ziebarth recommended that all the information be put in the Launching <br />Pad's file and reviewed when their license is again up for renewal. <br />BASEMENT REMODELLING BID AWARD <br />Engineer Hubbard reported that the bids for Project 1978 -2 City Hall Improvements <br />were opened January 19 and that four companies placed bids, and gave a presentation <br />of the bids and the options the City had in awarding the project. He also stated <br />that the costs of each option were construction costs only and that there would be <br />additional costs for printing specifications, publications of notices, mailings and <br />so forth. <br />Engineer Hubbard reported that the low bid for the four options was received from <br />Elview Construction, at $18,478.00, which was over the $14,300 budgeted for the <br />project but that the additional expense could be covered by the Revenue Sharing <br />fund. <br />Councilmember Baumgartner questioned where the restroom would go and if would be <br />one single restroom. Engineer Hubbard replied that it would go in the present <br />storage area and would be a single, one stall restroom. He also stated that code <br />requires one restroom per 15 people per floor. <br />Councilmember Baumgartner questioned if the bids could be awarded for everything <br />but the restroom. Engineer Hubbard replied that they could be but pointed out <br />that the cost of installing a restroom at a later date would probably exceed the <br />savings if the restroom were not installed in the package price. <br />5 ayes <br />
