April 10, 1978 Page 4 <br />made in the report match the techinical data. <br />Mr. McCarty stated that a person did not have to be a civil engineer to read the <br />report. He added that he had interviewed some of the home owners listed in the report and <br />that none of them had water problems as the report listed. He sited one address <br />as 5115 Eastwood. <br />Councilmember Baumgartner pointed out that Mr. McCarty had earlier stated that he <br />had checked with all 23 home owners listed in the report but was now saying that he <br />had just checked with some and asked how many Mr. McCarty had really checked with. <br />Jerry Foss of the Planning Commission stated that he had asked Mr. McCarty at the <br />Planning Commission meeting if there were civil engineers on the Steering Committee <br />and that Mr. McCarty had told him there were, and that he had relied on that answer <br />to make his decision on the Planning Commission recommendation to the Council on the <br />project. <br />Mr. Loeding stated that the point they were trying to make was that while there were <br />not any civil engineers on the Steering Committee, they did have expertise. He added <br />that he did not feel the summary of the report followed the technical data presented. <br />Mr. McCarty stated that he realized he had erroneously made the statement earlier <br />that he had checked with all 23 home owners and that he had only checked with five <br />so far. <br />Councilmember Rowley stated that if the Council and the Task Force were to work <br />together, she felt that they had all better make credible statements and make sure <br />they were correct. <br />Mr. McCarty stated that the list of names he had received from the June 5, 1975 <br />meeting of people that had water problems had actually been people who had wanted <br />the parks dried up. <br />Councilmember Hodges stated that he lives on Eastwood and that he knew the home <br />owners there had had water problems in 1975. <br />Mr. McCarty stated that he felt no one on the Steering Committee at any time <br />purposely mislead anyone. <br />Councilmember Ziebarth stated that at the April 6 Task Force meeting they had <br />discussed expanding the questionnaire to cover standing water as well as water <br />in basements and asked if that change had been made. Mr. McCarty replied that <br />it had, and that they hoped to get the survey going quickly. <br />Councilmember Ziebarth stated that he felt there would be a problem in getting <br />people to sign a statement saying they had had a wet basement as many of them <br />would be trying to sell their home at some later date and would not want such <br />a statement in writing. <br />Charles Hall, 2200 Highway 10, owner of the Mermaid, stated that he had never <br />thought about sueing the City but pointed out that he had gone before the Planning <br />Commission and City Council last year and received approval for his bowling alley <br />and had since spent thousands of dollars to get the project going. He stated <br />that he had had no idea while spending this money that anything like a moratorium <br />was going to happen and stated that he could very likely end up going bankrupt if <br />
