May 8, 1978 Page 7 <br />Mr. Loeding stated that he would like to have all the information that is available <br />and that he could discuss it further with the City Engineer. <br />Councilmember Ziebarth stated that it was his understanding that any information <br />that comes to the Planning Commission will be available to the Task Force. Admini- <br />strator Achen replied that the information will be presented to the Task Force <br />before the Planning Commission. Mayor Pickar added that the Task Force can find out <br />what is on the agenda before each Planning Commission meeting and study the issue. <br />Administrator Achen asked what would happen if the Task Force decides an item on the <br />Planning Commission agenda needs more discussion before it goes to the Planning <br />Commission. <br />Councilmember Baumgartner asked those present on the Task Force if they were speaking <br />as individuals or as representatives of the Task Force. Mr. Loeding replied that he <br />was speaking as a member of the Task Force. <br />Councilmember Baumgartner pointed out that a builder would not build a home that <br />would allow water to run into the home and that the water will run off someplace. <br />Mr. McCarty stated that the City has allowed people to build in places where they <br />should not have and that the City has not helped much in working toward solving the <br />problem. <br />Mayor Pickar called the meeting back to order. <br />Attorney Meyers stated that he had discussed the subdivision with Official Rose <br />and pointed out that the piece of property has 155' of frontage and one of the compli- <br />cating factors is that Staff is interested in proposing an east /west road which would <br />go across Ken Sjodin's property. He added that there have been discussions on a <br />north /south road but they have been turned down. He added that in 1976 the City <br />Council passed a resolution requiring the land owners to present a petition of 35% or <br />more of the property owners requesting a road before the Council would hear the issue <br />again. <br />Attorney Meyers pointed out that if the road does go through, the lot would become a <br />corner lot and thus should be required to be 100'. He also pointed out that the 772' <br />lot would require a variance and that variances can only be granted when undue hard- <br />ship is proven, and that Mr. Sjodin could get an 85' lot in. <br />Administrator Achen asked if Mr. Sjodin would be willing to deed the extra frontage <br />if the road goes through. Mr. Sjodin replied that he would but that he would not give <br />an easement without knowing if the road was going in. <br />Attorney Meyers questioned how Mr. Sjodin plans to get a variance for the lot size since <br />he would have to prove an undue hardship. Mr. Sjodin replied that there are other 75' <br />lots which have been allowed. Councilmember Baumgartner replied that hardship would <br />have to be shown. <br />Mr. Sjodin added that he has been told the Metro Council is recommending smaller lots <br />due to the high cost of assessments and homes. <br />MSP ( Pickar- Ziebarth) to table issue on minor subdivision at this time to allow for <br />circulation of a petition for a road, with a time limit of 30 days. 5 ayes <br />Mr. Sjodin asked why his minor subdivision request could not be approved now since <br />
