May 22, 1978 Page 5 <br />Councilmember Baumgartner reported that concern was expressed at the Planning <br />Commission meeting about a walkway going through the area and that an easement <br />was granted by the developer. <br />Mr. Murphy explained that the duplexes will be located on Lot 4, Block 1 and on <br />four different lots in Block 2, along the highway. <br />Harold Rotasch, 5135 Long Lake Road asked who will be responsible if there are water <br />problems. Engineer Hubbard replied that the water will back up and pond in the <br />highway ditch, which would not harm anyone. <br />Councilmember Ziebarth stated he felt a fence should be required along the walkway. <br />Councilmember Baumgartner replied that a fence could be required in the development <br />agreement. <br />MSP (Baumgartner- Hodges) to approve the preliminary plat of Mounds View Development <br />Company No. 1, dated May 19, 1978, with the following exceptions, that the water <br />line be rerouted for Spring Lake Road to Pleasant View Drive, that if the developer <br />cannot get approval from the Department of Transportation for an entrance onto <br />Highway 10 for Outlot A that Outlot A be included in Lot 6 or Lot 7, and that a <br />variance be granted on the front footages on Block 2 for Lots 1 and 13, with the Lot <br />13 variance because of a sanitary sewer easement running along the north end of the <br />property and Lot 1 due to the fact of the curve of Pleasant View Drive. Block 1, <br />Lot 3 has a 93' frontage. At the building setback line it would be 77'. Block 1, <br />Lot 4 is 215' on Pleasant View Drive, with a building setback of 75'. A variance <br />would be granted for both because of the dimensions of the two properties. The <br />first floor elevation shall be a minimum of 18" above street grade and a contribu- <br />tion to the SDM fund is required. 5 ayes <br />MSP (Baumgartner - Rowley) to direct that an ordinance be prepared to rezone the <br />following properties: Block 1, Lots 1, 2 and 3; Block 2, Lots 1, 3, 4, 7, 8, <br />9, 10, 11, 13, 14 and 15 rezoned from B -4 to R -1; and Block 1, Lot 4 and <br />Block 2, Lots 2, 5, 6 and 7 rezoned from B -4 to R -2, and include Outlot A. <br />Administrator Achen reported that notices had been mailed on May 7, 1978 for the <br />rezoning and preliminary plat. <br />Mayor Pickar closed the public hearing and opened the next public hearing. <br />TRUCK PARKING ORDINANCE - RAMSEY COUNTY DISTRICT COURT FINDINGS <br />Attorney Meyers reported that pursuant to court order the Council shall rehear <br />the plaintiffs. Notice of the hearing was sent to the plaintiffs and an official <br />legal notice was published. Attorney Meyers read the letter that the plaintiffs <br />received. <br />Diana Eagon, attorney for the Stimpsons, stated that the Stimpsons were living in <br />Mounds View since 1952 and in 1971 moved across the street to their present home <br />and obtained a building permit from the city for building a driveway for parking <br />their semi. They parked their truck there until December of 1977 when the city <br />began enforcing the parking ordinance. <br />Ms. Eagon stated that trucks are no noisier than snowmobiles or lawn mowers or <br />motorcycles. She added that Mr. Stimpson comes home with his truck every Thursday <br />and then leaves again on Saturday or Sunday. <br />Juel Mold, 2616 Hillview Road, stated he was to be notified by the Court of what <br />5 ayes <br />
