May 22, 1978 Page 8 <br />RECREATION CENTER BUILDING PERMIT - SCOTLAND GREEN APARTMENTS <br />Stan Kruger stated he was the representative from Wilmus Properties, owner of <br />Scotland Green and showed on a sketch plan what they planned on putting in. <br />Councilmember Baumgartner stated that Park Director Anderson had put out a memo <br />with his comments concerning the proposed activities, which contained many good <br />points. He added that the Planning Commission had recommended approval of the <br />recreational facility. <br />Engineer Hubbard explained the SDM charge to Mr. Kruger. Mr. Kruger replied that <br />he did not feel they were adding enough square feet to warrant a $4000 charge for <br />the SDM fund and asked to see the calculations. Engineer Hubbard replied that <br />they would be made available when the building permit is applied for. <br />Administrator Achen asked if Mr. Kruger had reviewed the recommendations made by <br />Park Director Anderson. Mr. Kruger replied that he had and he did not want to <br />put in a fence and did not feel the City should require it. <br />Elizabeth Flavin, manager of Scotland Green stated that she did not feel the <br />residents would be using the running track as such as they would continue running <br />on County Road H2 and the track would become more of a walkway. <br />Councilmember Baumgartner pointed out that it is Staff's responsibility to point <br />out each and every thing that should be covered and one of the items that was . <br />recommended was putting in a fence. He added he did not feel a development agreement <br />would be required if a fence was not required. <br />Councilmember Rowley stated that the felt the fence was an option for Scotland Green <br />to decide on, and that once the park is put in, there might be a problem with people <br />from the park going over to use Scotland Greens facilities. <br />MSP (Baumgartner - Ziebarth) to approve the building permit for Scotland Green Apart- <br />ments. 5 ayes <br />Councilmember Ziebarth stated he would like to see it written somewhere that the <br />owner has agreed to place a fence at his expense if it should become a problem for <br />him when the park is upgraded. <br />MSP (Ziebarth - Rowley) to amend the previous motion to include a written understanding <br />that it will be Scotland Greens responsibility for fencing. 5 ayes <br />FESTIVAL IN THE PARK - FIREWORKS AND INSURANCE EXPENDITURES <br />MSP (Pickar - Hodges) to approve the Staff recommendation to spend $150 to insure <br />the fireworks display and also approve the expenditure of $800 for fireworks <br />display by Northern Lighters. <br />5 ayes <br />PROPOSED ON -SALE LIQUOR ORDINANCE AMENDMENT - CLOSING AND CONTROL OF CONSUMPTION <br />IN PARKING LOTS <br />Attorney Meyers reviewed the proposed ordinance controlling the closing of liquor <br />establishments and drinking in parking lots.
