November 13, 1978 Page 3 <br />provided to allow effective community involvement, with 30 days notice for <br />public meetings and 15 days notice for informational meetings, and that the <br />issue of surface transportation be addressed for each of the horizon years <br />1985, 1990 and 2000, with the concern being that it relate to the plan for <br />New Trunk Highway 10 and the new accesses, and that facility requirements should <br />specifically address the need for on -site and off -site fire, rescue and law <br />enforcement service, with that being important to the neighboring taxpayers. <br />Councilmember Rowley noted that Mounds View has received a copy of the petition <br />from the League of Women Voters regarding the application. <br />Councilmember Baumgartner asked that a copy also be sent to the State Legislative <br />representative. Councilmember Rowley stated that she would like to go through the <br />file and pull out information to send to the new representatives. <br />5 ayes <br />Mayor Pickar recessed the general meeting and opened the first public hearing at 7 :55 PM. <br />VACATION OF EASEMENT - BERWYN ADDITION <br />Administrator Achen reported that the plat had been approved some time ago but that <br />the owner has had some problems closing on the property because of ambiguous easements. <br />Administrator Achen explained that due to the description, it was possible to locate <br />the easement area either fronting lots 1 and 2 of the Berwyn Addition or along the <br />east boundary of the Edgewood School property. He added that because of the descrip- <br />tion and to whom the easement is deeded from and to, it would appear that the easement <br />is along lots 1 and 2. The described easement to be vacated is located entirely within <br />the Edgewood Drive roadway easement. Administrator Achen stated that the City does <br />have documented easements for Edgewood Drive and the removal of this easement would not <br />violate any of the existing easements. <br />Mayor Pickar stated that the memo from the Building and Zoning Official goes into <br />detail about how the situation occurred. <br />Attorney Meyers pointed out that the easement has no practical use. <br />MSP (Ziebarth- Hodges) to adopt Resolution #944, vacating the highway easement dated <br />April 8, 1958 for the Berwyn Addition. <br />A rollcall vote was taken: <br />Councilmember Rowley - aye <br />Councilmember Ziebarth - aye <br />Councilmember Hodges - aye <br />Councilmember Baumgartner - aye <br />Mayor Pickar - aye <br />At 8:05 PM Mayor Pickar closed the public hearing for the vacation of easements <br />and opened the next public hearing. <br />5 ayes <br />
