March 12, 1979 Page 3 <br />Mayor McCarty stated that in reply to Mr. Herold's letter, Staff had <br />checked the lot and found that the dirt that had been brought in had <br />been taken out as ordered, and that some dirt on the lot had been <br />bulldozed around, which was what was still evident on the lot. Mr. <br />Herold replied that he did not agree that all the dirt had been taken <br />out again. <br />Mayor McCarty stated that in reference to Mr. Herold's comments on <br />Official Rose presenting the developer's plan at the February 26 meeting, <br />that he had to take the responsibility for it as he had called Official <br />Rose in from the hallway and asked him to present the plan to inform <br />residents present and the Council since the developer was not present, <br />and that he now realized he had put him out on a limb by doing that. He <br />added that in the future, if a developer is not present to present his <br />own plan, they will not be discussing such proposals. <br />Councilmember Rowley added that Official Rose had not recommended approval <br />of the plan as Mr. Herold had stated, but rather than he recommended a <br />study be ordered to determine the feasibility of the plan and the drainage <br />system. <br />Mr. Herold stated that he felt developers should be required to carry <br />high liability coverage to compensate for any water damage they might <br />cause. Attorney Meyers replied that this is required under the licensing <br />requirements and that not less than $50,000 is required by ordinance now. <br />Mayor McCarty stated that he advocates preventive medicine and that the <br />problems will be worked out step by step. <br />MSP (McCarty- Hodges) to continue the hearing on Bayport Acres indefinitely <br />on the basis that it not be taken up again until all the dirt is removed <br />and further, a letter be sent to the builder or his agent and have him <br />come in and provide successful proof that removal has taken place. 5 ayes <br />Acting Administrator Anderson pointed out on a City map the areas of tax <br />forfeited lands that the City is considering. <br />Roger Baumgartner, 7585 Knollwood Drive stated that he thought it would <br />be difficult to sell the land - locked pieces of property and questioned <br />what would happen to them. Mayor McCarty replied that he would like to <br />check on the areas in question before taking any action. <br />MSP (McCarty - Ziebarth) to delay action on the tax - forfeited land until <br />the first meeting in May. 5 ayes <br />Mayor McCarty recessed the regular meeting and opened the first public <br />hearing. <br />PUBLIC HEARING - NORTHCREST PARK ASSESSMENT <br />Attorney Meyers reported that the property owner has requested a 30 day <br />continuance due to the pending sale of the land. He added that the <br />assessments will be against the land, not the individual, and that the <br />owner's attorney has advised him that they will be appealing the assess- <br />ment. <br />
