April 9, 1979 Page 4 <br />Councilmember Ziebarth also stated that it is going to take money to <br />solve the problems. Mayor McCarty replied that the SDM fund will be <br />used for that purpose. Councilmember Ziebarth replied that the SDM <br />fund will only go so far and may or may not be enough to solve the <br />problems. Mayor McCarty replied that the SDM fund would be used <br />assuming that project costs would not exceed the SDM fund balance. <br />Councilmember Hodges asked Mayor McCarty if he thought the SDM fund <br />would take care of the problems on Woodcrest and Ardan Avenues. Mayor <br />McCarty replied that he did not know without having the necessary cost <br />estimates. Councilmember Hodges pointed out that if the Council <br />adopted the Mayor's proposed guidelines as a policy, it would tie <br />thei_ hands. Mayor McCarty replied that as long as the agreed <br />principles weren't in ordinance form that would allow the Council <br />flexibility. <br />Councilmember Forslund suggested the Council hold a work session with <br />Attorney Meyers and Official Rose and get their thoughts and words <br />down onto paper, as they were all getting hung up on the wording. <br />MS° (Forslund- Rowley) to table the discussion on proposed agreements - <br />in principle and discuss it exclusively at a special work session on <br />April 21 at 8:00 A.M. 5 ayes <br />Dave Notaro, Ardan Avenue, stated that he appreciated the Council's <br />efforts but that they had collected data from several sources and <br />should have enough to make a decision. <br />Mayor McCarty replied that the Council had asked a consulting engineer, <br />Chuck Hubbard, to give the Council an estimate on what it would cost <br />to have him study the Ardan Avenue problem and the Council will study <br />the estimate and decide if his services would be affordable. <br />Roger Baumgartner, 7585 Knollwood, pointed out that Mr. Hubbard will <br />be the fourth person to work on the problem and asked what will happen <br />if the Council does not like the fourth estimate. Mayor McCarty replied <br />that they will review his cost estimate and decide if it was affordable <br />and if it was the Council would take necessary action. <br />Councilmember Rowley clarified that while the Mayor had referred to <br />Council authorization for hiring a consulting engineer,. the Council <br />has not authorized it and recommended that a motion be made to <br />specifically address it, if that was the Council's desire. <br />Mr. Baumgartner pointed out that when the Council authorized Comstock <br />and Davis to study the issue in 1978, there were people in the audience <br />who were critical of what the Council directed them to study, and asked <br />what Mr. Hubbard was directed to study. Mayor McCarty replied that <br />they had not given him anything to study yet, as they want an estimate <br />first. Mr. Baumgartner pointed out that it is difficult to give an <br />estimate when a person does not know what they are giving the estimate fore <br />Mayor McCarty stated that the public hearing for Bayport Acres had <br />}een cancelled as the applicant had withdrawn his request, and closed <br />the regular meeting and opened the next public hearing. <br />
