MOUNDS VIEW CITY COUNCIL Regular Meeting <br />Page 9 February 25, 1980 <br />Meyers next brought up a question <br />over the Forder- Trucker project <br />concerning assessments be a portion <br />on their properties. He cautioned <br />the City Council on the apportionment, <br />but noted that it was legal and proper <br />for apportionment to occur. No other <br />action was taken regarding this matter. <br />He also indicated that the Forder and <br />Trucker Developers felt that they over- <br />built the line and wanted the City to <br />assist them in recapturing of the costs <br />they felt they spent in overbuilding <br />the system. Mr. Meyers noted that the <br />City could do very little to assist <br />them in recapturing some of these costs <br />from other buyers. <br />The Attorney wanted it noted for the <br />official record that the City had <br />received a settlement on the Wallard <br />Walijarvi case in the amount of <br />$23,000.00. He went on to say that <br />there was still one outstanding claim <br />to be settled in the amount of approxi- <br />mately $2,000.00. Finally he noted <br />that the City Treasurer should be aware <br />that the settlement contained a repay- <br />ment clause to the Architect. <br />The Mayor introduced proposed <br />Ordinance 295 creating proposed <br />Chapter 26 obtaining the City's Rules <br />& Regulations on Public Improvements <br />and Assessments. City had considerable <br />discussion over Article 26.09. Council <br />requested no amendments be made to the <br />proposal at this time. McCarty moved <br />that Feb. 25th be considered the first <br />reading of the proposed improvement <br />Chapter #26 and that the City dispense <br />with the reading of the proposed Ordi- <br />nance pursuant to the provisions <br />found under the City Charter 3.05 and <br />set the second hearing to be March 10, <br />1980.
