He further stated that there are no <br />windows on his side of the house that faces the <br />new addition. Mr. Chilinski stated the petition <br />was brought in to indicate to the Council that <br />the neighbors did not disagree with the const- <br />ruction of the addition. <br />PUBLIC HEARING CLOSED: 7:39 p.m. <br />REGULAR MEETING OPENED: 7:39 p.m. <br />MOTION: Councilmember Hodges made a motion, <br />seconded by Councilmember Doty to approve the <br />Variance for the sideyard setback at 5242 Red <br />Oak Drive. <br />Discussion of the Motion: <br />Hodges: He feels that the hardship was caused by <br />circumstances that were beyond their control. <br />Also, that the construction was taken too far <br />before it was stopped. <br />Doty: He feels that there are alternatives that <br />could have been made, but that the construction <br />has gone too far for a revision to be made. <br />McCarty: Due to an action not under the control <br />of the homeowner and that they were victim to <br />another parties action. <br />Vote was taken by calling of the roll. <br />5 ayes <br />0 nays MOTION CARRIED. <br />It was noted that Mr. Engel was not in atten- <br />dance. Clerk /Administrator Pauley stated <br />that staff was recommending that a verbal <br />reprimand be given. <br />Summary of Discussion: <br />- Administrative costs - that this error has <br />cost the City additional Administrative costs. <br />- Contractor should have attended the meeting. <br />- That the contractor had not been issued a <br />Building Permit before starting construction <br />on the addition. <br />4. Review of Contractor's <br />License - David J. Engel <br />MOTION: Mayor McCarty made a motion, seconded <br />by Councilmember Hodges to direct staff to send <br />a letter to Mr. Engel reprimanding him for work <br />that was done on the addition without the issuance <br />
