Mounds View City Council June 8, 1981 <br />Regular Meeting Page 7 <br />Councilmember Blanchard stated that she had no <br />comments or questions of the applicant at this <br />time. <br />Mayor McCarty questioned if the Council could <br />require an agreement so that if the water main <br />broke, the City would not be responsible for <br />any damage done during its repair. Attorney <br />Meyers replied that as part of the Development <br />Agreement, the City would be held harmless for <br />any damage done to a permanent structure. <br />Mayor McCarty stated he would like an indica- <br />tion of confidence from that applicant that if <br />the noise did prove to be a problem, they would <br />have a conditional use review in the future, <br />and would the applicant be willing to put up a <br />letter of credit or whatever regarding loss of <br />property value. Mr. Tyson replied that he would <br />like a chance to discuss those requirements and <br />check into them, but that he would be willing <br />to do anything within reason. He asked that it <br />be remembered that there are other trucking firms <br />in the area already that are creating noise, and <br />that he will be doing more to surpress the noise <br />than they have. <br />Motion /Second: McCarty /Hodges to direct Staff to <br />draft a tax exempt financing resolution and deve- <br />lopment agreement with a resolution to include <br />the Planning Commission's considerations, and give <br />preliminary approval to the proposal, with the <br />development agreement to include a negotiable <br />warrantee to the adjacent property owners, to <br />include the Mounds View Planning Commission's <br />Resolution No. 16 -81. <br />5 ayes <br />0 nays Motion Carried <br />Attorney Meyers asked that it be noted that the <br />applicant was aware of the tax exempt financing <br />requirements and that they had been given a <br />copy of them. <br />Mayor McCarty closed the regular meeting and <br />opened the public hearing for the rezoning for <br />John Engberg at 9:39 PM. <br />George Engberg stated that he was present for 13. Rezoning for John <br />she request. Engberg, 3032 County <br />Road J <br />Official Rose recommended that Staff be directed <br />to draft an ordinance for approval of rezoning <br />
