Mounds View City Council <br />Regular Meeting <br />July 13, 1981 <br />Page Five <br />ttorney Meyers explained that Ordinance No. 301 <br />prohibits development, during the moritorium, of <br />any wetlands in the City. Ordinance No. 305 <br />allows the procedure whereby the City can allow <br />development of dry and buildable portions of land, <br />but wetlands cannot be touched until the ordinance <br />is repealed. Resolution No. 983 is only to be <br />considered for the dry, buildable land. <br />Edward Hance, attorney for Mr. Eigenheer, stated <br />that the Ramsey County Soil and Water Conservation <br />District had determined lots 17, 18 and 19 should <br />not be developed, and that they are not asking for <br />approval to build on those lots, but are asking <br />for approval of the plat. <br />Mayor McCarty stated he was concerned if Edgewood <br />Road was in the wetland and if the developer could <br />do anything on lots 17, 18 and 19. A lengthy <br />discussion followed on the definition of wetlands. <br />Motion /Second: McCarty /Doty to direct Staff to <br />request Tom Peterson of the Ramsey Council Soil and <br />Water Conservation District to give a determination <br />-)f whether or not the road on the proposed plat for <br />ounds View Square should be considered within the <br />Hype of wetlands that are prohibited under Exhibit <br />A, and that the developer dedicate lots 17, 18 and <br />19 as storm water easement and the developer's <br />engineer show to the satisfaction of the City's <br />Engineer compliance with Resolution No. 983. <br />4 ayes 0 nays <br />Mayor McCarty added that the dedication of lots <br />17, 18 and 19 could also be the considered the <br />buffer zone of Ordinance No. 305, if necessary. <br />Motion /Second: McCarty /Doty to approve the <br />second reading of Ordinance No. 307 amending <br />the municipal code of Mounds View by amending <br />Chapter 41 entitled "Specific Rezonings" and <br />waive the reading. <br />A rollcall vote was taken: <br />Councilmember Blanchard - aye <br />Councilmember Doty - aye <br />Councilmember Hodges - aye <br />Mayor McCarty - aye <br />4 ayes 0 nays <br />Motion Carried <br />9. Second Reading of <br />Ordinance No. 307 <br />Amending the Municipal <br />Code of Mounds View by <br />Amending Chapter 41 <br />Entitled "Specific <br />Rezonings" <br />Motion Carried <br />
