Mounds View City Council July 13, 1981 <br />Regular Meeting Page Seven <br />fficial Rose reported that Mary Anderson <br />riomes hopes to begin moving equipment in for <br />the Kraus - Anderson development next week and <br />asked that Staff be given approval to issue <br />a grading permit. He also stated that they <br />would like to have the Council and Press <br />available for the ground- breaking ceremony. <br />He added that they would be submitting the <br />public improvements bond later during the <br />week. <br />Motion /Second: McCarty /Blanchard to authorize <br />Staff to grant a grading permit, contingent <br />upon the approval of the City Attorney. <br />4 ayes 0 nays <br />Official Rose reported that there had been <br />some problems with the First State Bank of <br />New Brighton development. Attorney Meyers <br />explained that Sahara Investment Co. wants <br />to add some clauses to the development <br />agreement which basically states they are <br />paying fees under protest. He also stated <br />'-hat their letter of credit does not meet <br />ze requirements of the City. <br />Motion /Second: McCarty /Doty to direct Staff <br />to inform the principles involved in the <br />bank development of the provision in the <br />ordinance under which the Council has the <br />authority to double -fee a developer who <br />starts without a permit, and direct that <br />Staff not issue permits until they are in <br />compliance with the development agreement <br />4 ayes 0 nays <br />Attorney Meyers reported that on June 30, <br />the Court denied the injunction of the <br />Launching Pad. He added that he had just <br />filed the City's answer to the lawsuit, <br />and that he has received calls and is <br />relaying the Council's position to all <br />concerned that a license will not be <br />issued to anyone until the lawsuit is <br />resolved. <br />-)uncilmember Doty reported that he had <br />with the ad -hoc Mayor's committee on <br />storm water wetlands. <br />13.
