Mounds View City Council October 26, 1981 <br />Regular Meeting Page Two <br />,ubmitted a grading plan which meets all set <br />requirements. He added that the Planning <br />Commission has seen the Tyson proposal and <br />they are not required to view the final <br />plans. <br />It was the concensus of the Council that Tyson <br />Trucking was a reliable business and it was <br />felt they would follow through with their <br />agreement if a grading permit was issued. <br />Attorney Meyers advised that an irrevocable <br />letter of credit or bond would satisfy the <br />requirements of the City, and a provision <br />should be made that the City is not waiving <br />its rights to review building permits or its <br />right to assess any charges. <br />Motion /Second: McCarty /Hodges that the City <br />Council authorize the appropriate Staff <br />members and City Engineer to review and <br />approve the site grading plan for Tyson <br />Trucking and issue a permit thereto, <br />noting that the City is not waiving its <br />'ights to any and all charges under the <br />Applicable ordinances and adequate security <br />be determined and secure a bond in the <br />favor of the City for those charges, <br />specifically SDM and building permit charges. <br />5 ayes 0 nays <br />Councilmember Doty asked that Item C be <br />removed for discussion. <br />Motion /Second: Blanchard /Forslund to <br />approve the Consent Agenda, minus <br />Item C. <br />5 ayes 0 nays <br />Councilmember Doty stated he felt Lake Court <br />Drive will be a heavily traveled street <br />and, thus, should be designated a MSA street. <br />Clerk /Administrator Pauley replied that he <br />and Dan Boxrud had reviewed the denial and <br />the determining factor in the denial had <br />seemed to be the street length. He added <br />that it was their opinion that if the <br />-1enial was appealed, it could have a nega- <br />ive effect on the City at a later date. <br />It was decided to discuss the issue later <br />in the meeting after Mr. Boxrud arrived. <br />Motion Carried <br />5.
