Mounds View City Council November 24, 1981 <br />Regular Meeting Page Five <br />t was the concensus of the Council that the lot <br />in question definitely needed drain tile, and in <br />order to protect the City from a lawsuit by a future . <br />purchaser of the home, that drain tile should be <br />required. <br />Motion /Second: McCarty /Doty to deny the request of <br />Timberline Homes, Inc. to omit the drain tile at <br />7741 Greenwood Drive. <br />4 ayes 0 nays <br />Clerk /Administrator Pauley stated the Planning <br />Commission is in the process of reviewing <br />Chapter 40 and recommended any implementation <br />of code procedures should wait until they are <br />finished. Official Rose stated they would most <br />likely be completing it in January. <br />Mayor McCarty pointed out that the developer <br />is required to include a negotiable warrantee <br />to the adjacent property owners, and recommended <br />it be stipulated in Exhibit 2A of the development <br />agreement. <br />.ir. Tyson stated that any violation of MPCA <br />standards would come under State jurisdiction, <br />and they could be shut down if they violated <br />the standards. <br />Mayor McCarty asked for some type of written <br />agreement that could be given to the mobile home <br />park owner. Mr. Tyson replied he would be glad <br />to put in writing that he would not violate the <br />State standards. He added that he would prefer <br />not having to build a wall, as they would <br />rather use bearming, screening and trees and so <br />forth. <br />Official Rose explained Item 5 of Exhibit 2A had <br />been included as it was referred to on the site <br />plan. It was agreed to change the wording to <br />read that the developer agrees to install an <br />adequate buffer, reference Chapter 40.04 sub G. <br />Motion /Second: McCarty /Doty to approve Resolution <br />No. 1383 and waive the reading of the resolution. <br />4 ayes 0 nays <br />Aotion /Second: Forslund /Blanchard to have the <br />Police Department donate the bicycles to the <br />Goodwill. <br />4 ayes 0 nays <br />11 <br />Motion Carried <br />.
