L". e,_'-..'._ - . .. .«_ ,..__'_�"— __ <br />MOUNDS VIEW PLANNING COMMISSION <br />RESOLUTION 1�10. 532-98 <br />CITY OF MOUI�IDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTI�1`�T DENYING A 7 FOOT VARIANCE TO THE R]EQUIRED 30 FOO'I' <br />BUILDING SETBACK FROM A PUBLIC ROAD RIGHT-OF-WAY ALONG ARDAN <br />AVENUE FOR THE CONSTRUCTION OF A NEW SINGLE-FAMILY HOME AT <br />8265 SPRING LAKE ROAD; <br />PLANNING CASE NO. 513-98 <br />WHEREAS, the IVlounds View Planning Commission has reviewed the request of <br />Preferred Builders, Inc. to allow a 7 foot variance to the required 30 foot building setbacic from a <br />public road right-of-way for the construction of a single family home at 8265 Spring Lalce Road; <br />and, <br />WHEREAS, this properiy is zoned R-1, Single Family Residential District and is legally <br />described as: <br />Tfie North S3 feet of the West 218 feet of Lot 34, and the Soutfi 27feet of the West 213 feet of <br />Lot 35, all in Auditors Subdivision No. 89, Ramsey County <br />WHEREAS, the Planning Commission has reviewed the following documents associated <br />with this request: <br />1. Planning Application <br />2. Location Map <br />3. Buildin� Front Elevation <br />4. Letter from the Applicant <br />5. Encroachment Map <br />6. Survey of Previous Home <br />WHEREAS, the applicant requests a 7 foot variance to the required 30 foot building <br />setback from a public road as required in Section 1104.01, Subd. 3, of the Mounds View <br />Municipal Code; and, <br />WHEREAS, the applicant presented a hardship statement to the Planning Commission <br />stating that the lot dimensions were substandard for a corner lot and that the proposed home <br />cannot meet the setback requirements without a variance; and, <br />WHEREAS, there are no e:ctraordinary or exceptional circumstances that apply to this <br />property that would justify the granting of this variance request; and, <br />
