___ <br />t___. <br />_ , _ ;; <br />Planning Case No. 513-98 <br />8265 Spring Lake Road <br />February 18, 1998 <br />Page 3 <br />Analysis: <br />According to City Code Section 1104.01, Subd. 3., a 30 foot building setback is required along <br />all public streets for lots located in the R-1 zoning districts of the city. The applicant is <br />requesting an additional7 feet to build the proposed hotne. The lot is 80 feet in width and is <br />located on a corner which creates some site constraints. The home previously lecated on the lot <br />was 19.4 feet from the public road right-of-way along Ardan Avenue (see a�tached lot survey). <br />The proposed home would be 23.1 feet from Ardan Avenue. <br />Orienting the home to Ardan Avenue would not alleviate the variance request for the proposed <br />home and would most likely require an additional variance. An orientation of fihe home to <br />Spring Lake Road would allow for a home with a maYimum width of 45 feet. Therefore, the <br />canstruction of a single family home witli a two car garage wculd be accommodated on the <br />proposed lot �Nithout the need fcr a variance. <br />The proposed variance fails to meet hardship criteria for granting a variance as outlined in <br />Section 1125.02, Subd. 2 of the City Code. The proposed lot will support tl�e construction of a 3 <br />bedroom, 2 bath single family home with a 2 car garage as required in the EDA's Housing <br />Replacement Progratn site criteria.
