EXHIBIT A <br />NIOUNDS VIEW PLANNING COMMISSION <br />RESOLUTION N0. 532-98 <br />CITY OF MOUNDS VIEW <br />COUNTY OF R.�I�ISEY <br />STATE OF MINNESOTA <br />RESOLUTION APPROVING A 4 FOOT VA.RIA��fCE TO THE REQUTRED 30 FOOT <br />BUILDING SETBACK FROM A PUBLIC ROAD RIGHT-OF-WAY ALONG ARDAIY <br />AVENUE FOR THE CONSTRUCTION OF A NEW SINGLE FAi�IILY HOME AT <br />826� SPRING LAKE ROAD; <br />PLANNING CASE NO. 513-98 <br />WI�REAS, the Mounds View Planning Commission has reviewed the request of <br />Preferred Builders, Inc. to allow a 4 foot variance to the required 30 foot building setback from a <br />public road right-of-way for the construction of a single family home at 8265 Spring Lake Road; <br />and, <br />WHEREAS, this property is zoned R-1, Single Family Residential District and is legally <br />described as: <br />The North 53 feet of the West 218 feet of Lot 34, and the South 27 feet of tfie West Z18 feet of <br />Lot 35, all in Auditors Subdivision No. 89, Ramsey County <br />WI-�REAS, the Planning Commission has reviewed the following documents associated <br />with tliis request: <br />l. Planning Application <br />2. Location Map <br />3. Building Front Elevation <br />4. Letter from the Applicant <br />5. Encroachment Map <br />6. Survey of Previous Home <br />WHEREAS, the applicant requests a 4 foot variance to the requized 30 foot building <br />setback from a public road as required in Section 1104.01, Subd. 3, of the Mounds View <br />Municipal Code; and, <br />WHEREAS, the applicant presented a hardship statement to the Planning Commission <br />stating that the lot dimensions were substandard for a comer lot and that the proposed home <br />cannot meet the setback requirements without a variance; and, <br />WI-�REAS, the literal interpretation of the provisions of this Title would deprive the <br />applicant of rights commonly enjoyed by other properties in the same district in that homes in <br />the surrounding neighborhood are comparable in size to the proposed home; and <br />
