REQUEST FOR PLANNING COMMISSION ACTION <br />Meeting Date: September 16, 1998 <br />Staff Report by: James Ericson, Planning Associate <br />Planning Case No.: 536 -98 <br />Applicant: Daniel Hall & Charles Herbst <br />Request: The applicants are requesting a zero -foot parking lot setback to allow <br />for a joint -use parking lot between the Mermaid and Perkins <br />restaurants. <br />Location: 2200 - 2214 Highway 10 <br />PIN Nos. <br />Mermaid: 08-30-23-43-0006, <br />08- 30 -23 -43 -0007, <br />08-30-23-43-0008 <br />Perkins: 08-30-23-41-0010 <br />Zoning/Land Use: B -3, Highway Business District / Bowling & Entertainment Center, <br />Restaurant <br />Applicable Regulations: <br />Section 1104.01, Subd. 4c(2)(b): Parking lots shall maintain a five -foot setback from the <br />side and rear property lines. <br />Section 1125.02, Subd. 2 outlines the criteria to be used by the Planning Commission in its <br />review of variances. <br />Attachments: <br />Background: <br />Planning Application <br />Zoning Map <br />Site Plan <br />Joint Use Agreement <br />Resolution 560 -98 <br />The applicants are requesting a variance from the required five -foot setback established for parking <br />lots in a business district. The parking lot for the Mermaid has been expanded and resurfaced in <br />accordance with the development plans submitted to and approved by the City on May 11, 1998. It <br />was discovered after the fact that the development plans were in error, such that the parking lot <br />north of the building encroaches into the required sideyard setback and in one area crosses the <br />property line onto the Perkins property. <br />
