REQUEST FOR PLANNING COMMISSION ACTION <br />Meeting Date: September 16, 1998 <br />Staff Report by: James Ericson, Planning Associate <br />Planning Case No.: 535 -98 <br />Applicant: Michael Tobias <br />Request: The applicant is requesting a variance to allow for two curb -cuts at his <br />residence at the northeast corner of Eastwood Road and Sherwood <br />Road. <br />Location: 8111 Eastwood Road <br />PIN Nos. 06- 30 -23 -14 -0009 <br />Zoning/Land Use: R -1, Single - Family Residential / Single - family residence <br />Applicable Regulations: <br />Section 1121.09, Subd 5e, which states that "Single - family uses shall be limited to one <br />curb cut access per property unless, upon application for a variance of this restriction, the <br />Board of Adjustments and Appeals finds that it is in the interest of public safety to waive <br />such." <br />Section 1125.02, Subd. 2 outlines the criteria to be used by the Planning Commission in its <br />review of variances. <br />Attachments: <br />Background: <br />Planning Application <br />Zoning Map <br />Location Map <br />Letter to Applicant, dated 7/28/98 <br />Area Curb-cut Survey <br />Resolution 558 -98 <br />The applicant is requesting a variance from the Code requirement that states a single - family <br />property shall be limited to only one curb cut. Earlier this year, the applicant took out a building <br />permit to resurface his driveway, which had access onto both Sherwood Road and Eastwood Road. <br />At the time, staff indicated that a building permit could not be approved due to the non - conforming <br />nature of the driveway, unless the access to Sherwood Road was removed. The applicant agreed <br />and the permit was issued. Subsequent reinspection of the property showed that both access points <br />remained, both having been improved contrary to the permit.
