PL��NTrING CASE NO. 466-96 <br />November 14, 1996 <br />Page 2 <br />�acl�grou�d: <br />This minog subdivision does not creat� an additional lat but instead takes a 12 �/Z fooi wide <br />strip of land from one tot and adds it to the adjoining lot to the north. This action would <br />formalize a previous agreement made with the property owner to the north and Mr. Beach. <br />The property owner to the souih was informed of this impending action prior to the <br />purchase of 7532 Silver Lake Road. Because drainage and utility easements have already <br />been recorded for the existing configuration of the two lots, they will need to be amended in <br />such a wa.y that vacates the old side loi easement between the two properties and creates a <br />new ten (10) foot wide easement centered an the revised side lot property lines. <br />Documents describing the vacated and nerv easements sha11 be provided by the applicani <br />and verified by the City Attorney and staff prior to your meeting on December 4. <br />Analysiso <br />The minimum square foo#age for lot area required by the Code is 12,500 feet. The <br />properties currently well exceed that requirement with 20,853 square feet for the property <br />to the north and 2b,075 square feet for the property to ihe south. After #�e re-subd►vision, <br />the properiies will remain in compliance with this requirement with 23,460 squar� feet for <br />the property to the north and 23,468 square feet for the property to the south. Currently, <br />#he properties meet or exceed the minimum tot width requiremeni (100 feet for the <br />northerly property and 125 feet for the southerly property.) After the re-subdivision, fihe <br />width of the properties will be 112.5 feef for both. <br />The applicant has provided a revised Certificate of Survey for the properties located at <br />7540 and 7532 Silver Lake Road. This revised Certificate of Survey shows the property <br />lines and easements as revised with the former property lines and easements in the <br />background. The revised lots have been Iabeled as Parcel X(7540 Sitver Lake Road) and <br />Parcel Y(7532 Siiver Lake Road.) The Certificate of Suzvey includes the revised legai <br />descriptions for both parceis, �.s welt as their former descriptions. <br />ltecammes�datior�< <br />Staff is favorable toward the approvai of this minor subdivision if the following <br />requirements are met; <br />The applicant shail submit the signed, revised easements prior to the City CounciI's <br />action on this item. The easements are expected for your meeting on December 4. <br />2, The applicant shall provide the City with a park dedication fee in the amount of <br />$100 per Code requirements in Section 1204,02. <br />The appiicant sha11 provide the City with notarized letters of permission from <br />William Culpert and Richard Edin, owners of 7532 and 7540 Siiver Lake Road, <br />respectively. <br />
