Engen Varianc Request
Plannig Case No. 496-97
.ugust 20, 1997
Pag 2
Code, are gravel, bricic, or asphalt. The neighbors affected by this proposal, Frank and Judy ilvis
of 223' Oakwood Irive, have subm.itted a lettr indicating their approval of a eement drive next to
their property line. It is sta.$'s opinion thai, for all intents and purposes, cemeni driveways are just
as "temporary" as asphlt driveways. Were it not for the refe°ence in the Code thai disallows
cemert drives witivn the five foot sid yard setback, staffwouId be supportive of this request.
The Codes of this City have been put into place to ensure the orderly growth and development of
ihe community wlle simultaneously protectin the heattll, safeiy, general welfare, comfort and
repose of the residents. To devite frorrr these Codes, there rnust be a compelling reason to do so.
Ther are seven stadards which need to be met in ordr to justify the Joard of Adjustmnts and
Appeal's granting of a variance. These criteria are stated in Sectior 115.02, Subd. 2 of the City
Code. All seven af the criteria have been met.
ltecoanreendatiora:
Sia.ff recorrurtends approval of Planning Commission Resolution 525-97, a resolution approving
the variance request of A, G.
