Plann'vng Case No. 505-97 <br />Mounds View Business Park East Second Add'n Plat <br />October 1, 1997 <br />Page 2 <br />Analys�so <br />According to Sec'tion 1242.01, Subdivision 1 of the City Code, full platting is required for all major <br />subdivision rec}uests. The applicant, Everesi Development, LTD., is eequesting approval of a <br />preliminary pIat for the praposed Mounds View Business Park East 2nd Addition. R�view of this <br />plat is required by the City Engirteer, the Director of Public V�orks, the City Atiomey, Rice Creek <br />Watershed District, and itamsey County. Ai the time this report was written, no comments had <br />been rec�ived back. The plati, dated 9/8/97, bears the necessary data for both peeiiminary and final <br />plats, as speci�ied in the Ciiy Code. <br />As with any subdivision of Iand within Nlounds View, two issues need to be addressed. The first is <br />easements. As a resui� of previous plattings, easements have already been dedicated to the City <br />which will need to be vacated as a conditian of this plat's approval. Vacations are done by <br />ordinance, and staff'has requested the City Attorney to draft the necessary language to accomplish <br />this. The areas to be vacated are highlighted on th� 8'/a by 11 pla� reduction attached to this report. <br />The applicant will need �o provide the appropriate le�al descriptions of the easement areas to be <br />vacated. From discussions with Jim Hess, the City's Engineering Techniciay�, ii may be the cas� <br />that additional right of way may need to be dedicated along Program Avenue to ailow far an 80- <br />foot continuous right of way where there is currently oniy 60 feeY. Be%re the new drainage and <br />uiility easemenis can be shown on the p�at, the Director of Public Works will make a deternunation ,'; <br />regarding the specific right of way dimensions. This wili be done prior to your next meetin� i <br />scheduled for October 15, 1997. - <br />The other issue addressed with every suhdivision of Iand is ihe park dedication requirements. <br />According to Section 12Q4,02 of the City Code, alI subdividers of iand are required to dedicate to <br />the City for public purposes a portion of land, or, ai the City's soie discretian, an equivalent <br />amount in cash based upon �he fair market value of the undeveloped land. It has been and <br />continues io be the City poIicy of requiring a cash dedication in lie�a of land. For commercial and <br />industzial lands, the appropriate figure is ten percent. Because this proposal replats land for which <br />park dedication fees have already beec� paid, Subd. 6 of Sectian 1204.02 relating to dedications for <br />re-subdivision applies. Attached to this report is a letter dated 9/3/97 to the applicant indicating the <br />exact park c�edication fee that wilt be required for this re-subdivision. Also attached is a response <br />from the appiicant dated 9/18/97 which disputes the City's interpretation of the park dedicaiion <br />requirements. Sta�i' maintains thai the appropriate park dedication fee for this re-subdivision is <br />�Sd,771, which amounts to ten percent of the land's fair markei value less prior park dedicatiot� <br />payments made for these properties. The Mounds View Parks and Rec�°eation Com�nis5ion, at its <br />meeting on September 25, 1997, voied to recor►urtend to the Ciiy Council an approximate park <br />dedication fee of �60,000 as autlined by staff in the letter dated 9/3/97. The Planing Comtriission, <br />before it acts on this request at its next meetin�, will need to re�eive either writien or verbal <br />assurance from th� applicant that fhe appropriate park dedication fee witl be paid. <br />I3�corr`en�r�ci�taon: <br />
