' .;:. - : :: :
To: liounds View Planning Commission
From; James Ericson, Planning Associate
Suhject: Code Interpretation: ectior 1121,10, Subd 6.
Ia.te: Meeting of October 1, 1997
aclrouci:
The property owner of 2109 Iillview Road, I3on Leshovsky, has approached the City with a
desire to install temporary parking spaces adjacent to tihe existing improved parking area. This
has come about as a result of vhicles being parked on the grass at this four-plex. Istallation oi
temporary spaces consisting o class S gravel would alleviate the parking problems being
experienced.
Analy9o
' On the surface, this request seems simple enough. However, it was pointed out by tke Rick
Jarson, the City's building inspector, that gravel parking surfaces are not allawed in this particular
zoning district. (The faur-plex is located in an R-3 District.) I couid not find reference to this
disailowance in the Code until I found Section 1121.09, Subd. 6, which pertains to "Grade
Elevations." I have included a copy of this for your referrence, The Code does state tha.t exeept
for R-1 and R-2 districts, atl driveways and parking areas shall be bituminous. (Concrete is not
even listed as an option.} However, further down in the same paragraph, iemporary surfaces are
addressed, whereby gravei surFaces are altawed. I think the two references conflict with each
other making the intent of the subdivision unclear. In its travels through the City, Staff has
obseroed a number of temporary and unimproved parking areas/driveways in the R-3 Iistrici.
Reeortaendation:
The Planning Cornmission, acting as the Board of Adjustments and Appeals, needs io interpret the
Code with regard to gravel parking surfaces in districts other thai I-1 and It-2 to determine
whether a temporary surfaces wou(d be allowed i 2109 Hillview Road, until such time tha.t ihe
Code can he rewriten to clarify this rceference.
i'
