Abughweili �o open a tobacco shap in Silver <br />View Plaza, which is zoned B-2, Limited Business District. �ince "tobacco shop" is not Gsted as <br />one af the perrnitted uses in this district, staff is seelring guidance from the PIat�ning Commission <br />on a code ir�terpretation whether ac not such a use should be allowed. <br />�'�y Dis�ussion: <br />Low iniensity, reYa�l or service outlets �vhich deal direc�Iy wiih the customer for whom the goods <br />or services are furnished are typical of this district. Examples af such uses are finance agencies, <br />health and bsauty salons, antique shops, delis, drugstores, etc. While a iobacco business is not <br />specifically Iisted as a permitted use, staff would contend that it is the type of use that would be <br />appropriate for t4�s zoning district. In fact, some of the listed uses (dnagstore, liquor store and <br />convenience gracery) are ones where a person would likely find tobacco products. If the Pianning <br />Commission feels the same way, staffwould recommend that a tobacco shop be interpreted as a <br />drug store and as such, be allowed in Silver View PIaza, property zoned B-2, Limted Business <br />District. <br />Recominenti�t�on: <br />The �ianning Commission, acting as th� Board of Adjustments and Appeats, finds that a limited <br />retail use of�erin� to the puhiic tobacco products shail be considered a dnag store for the purpose <br />of interpreting the Zoning Code, until such time that the Zoning Cod� is updated and a specific <br />reference to tobacco shops is added. <br />N:ldata\�oupslcomdevldevcases1509-97\tobacco.pc <br />
