<br />At its iast meeting, the Planning Commission reviewed a third comprehensive draft revision to
<br />the 5ign Code. Based upon the discussions of that meeting, staff was provided further input and
<br />direction ar�d has compiled the fourth con�prehensive draft revisian to the Code. This report will
<br />address the changes made between the third and fourth drafts as well as to address issues raised
<br />by tl�e City Attorney.

<br />Accarding to Scott Riggs (SR), the "abandoned sign" defulition could be vaguely interpreted. Did
<br />not however recommend a chan e.
<br />Based on discussion from last meeting, definition for "flag or pesviant sixingers" was revised Eo
<br />elimuiate xeference to national , state or local flags.
<br />Updated Section reference from 1008.01 to 100�.02.
<br />Updated Section reference from 1008.08(11) to 1008.10, Subd. 7.
<br />SR had a question about tlie required liability insurance amounts and whether the limits have
<br />increased since this Code was drafted. Staff will investi ate this ossibilz .
<br />Subd. 1 g refers to sign content deemed obscene by a court of compe#ent yurisdiction. 5R was
<br />nnaware of any such "obscene words list" hut would check into it. Either way, the language is
<br />ambi ous enou h so that it would nat be a violation of #he FirsY Amendment free s eech.
<br />Subd. lh refers to obsolete sign copy. SR feels this is somewhat subjective though not enough to
<br />warrant changing He did suggest adding language relating to "nuisance signs."
<br />Subd lk refers to signs along freeways. SR feels the added language would eliminate any
<br />otential inconsis#encies with state or federal stahztes.
<br />SR considers Subd. 4a{4) to he vague and open to challenge, yet admitted the likelihood of this
<br />actualty happening woutd be remote, (Disczetionary waiver.}
<br />Added Couucii approval for beacons in Subd. 4c.
<br />Allows for inflatable signs to be attached to the ground in addiiion to a building.
<br />Subd. 4f notes that individual flags, strearners or pennants shail nat exceed one square foot.
