Resolution 683-01 <br />Page 2 <br />W�REAS, the Engineering Technician and Community Development Director for the ' <br />City of 1Vlounds View have reviewed the Certificate for the proposed minor subdivision and have <br />found it acceptable, subject to minor revisions as noted herein; and, <br />Wf�REAS, a copy of the Certificate and Plat of Survey has been forwarded to the City <br />Attorney for his review; and, <br />WHEREAS, no park dedication fees shall be required with this subdivision due to the re <br />being no new additionaI lots created by this subdivision. <br />NOW, THEREFQRE, BE IT RESOLVED that the Mounds View Planning Commission <br />recommends approval of the minor subdivision request made by Marshall Mills, owner of 7630 <br />Woodlawn Drive and 7618 Edgewood Drive, subject to the following: <br />1. The Certificate and Plat of Survey shall be revised to show all existing easements and all <br />proposed easements, as shown in staff's Easement Exhibit, attached as Exhibit A. <br />2. The Certificate and Plat of Survey shall be revised by adding the following language: <br />"Separate drainage and utility easement documents cme to be recorded <br />with Ramsey County covering those areas so indicated rn this Certificate <br />of Plat and Survey." <br />The Certificate and Plat of Survey shall be revised to indicate the original square footages -_ � <br />for Lots 12 and 20, under the heading "Original Descriptions." <br />4. The applicant shall execute and record two easement documents (one for each lot} which <br />dedicate to the public for public use the proposed additional easement areas. <br />5. No structures shall be allowed in any easement area. <br />6. Prior to the issuance of any building or zoning pernuts related to construction activity that <br />would encroach or approach the existing s�orm sewer easement, the Director of <br />Community Development shall review the plans to ensure the requirements af this minor <br />subdivision resolution are adhered �o. <br />7. The applicant sha11 execute a limited use agreement in the event he would like to utilize <br />area within the easement for parking. In no event shall the City be liable for any damage <br />caused to any improvements within the easement or for restoration of same resulting from <br />normal or necessary service or repair to existing or future utilities insta�iations. <br />8. The applicant shall he responsible for recording the Council's resolution of approval, the <br />certificate and plat of survey and the revised deeds with Ramsey County within 60 days of <br />Council approval. Failure to do so within the prescribed timeframe (excluding <br />unavoidable delays as determined by the Community Development Director) sha11 render <br />this minor subdivision and this resolution null and void. <br />
