���= <br />Meinert Report <br />May 17, 2000 <br />Page 3 <br />e. <br />f. <br />Tlzat the va��iance i•equested is tlze �niniJ�zuJn variance whicl� would alleviate the hardslzip. <br />Econoinic conditions alone sliall �2ot be considered a I�ai�dslzip. <br />The requested variance exceeds the minimum necessary to allow a two car garage to be <br />constructed on the site. According to the information provided by the applicant there is <br />approximately 32 feet from the existing house to the side property line in question. There <br />would be room to construct a 22 foot wide two car garage which would only require a one <br />foot variance while maintaining the required six foot separation between the new two-car <br />garage and the existing house. A variance could also be granted to allow the existing <br />garage to be expanded to 23 feet in width. A two-car garage could also be constructed in <br />the rear yard without a variance. <br />The varzance would not be materially detrimental to the purpose of this Title or to otJzer• <br />property in the same zone. <br />The purpose of the variance provision in the Code is to give relief to property owners <br />seeking to improve their properties yet are unable to do so because of zoning code <br />requirements and factors beyond their control. Granting this variance for a zero foot <br />setbacic would be materially detrimental to the purpose of this Title or to other property in <br />the same zone. Side yard setbacic requirements are in place to allow proper separation <br />between structures for health, safety, and aesthetic reasons. <br />g. The proposed va�iance will not impair an adequate supply of light and air to adjacent <br />prope��ty oY substantially increase tlze congestion of the public sti°eets or incf�ease tlie <br />danger of fire or endanger the public safety or substantially diininish or iTnpaiY pT�opef°ty <br />values within tlze neighborliood. <br />The proposed garage could impair the supply of light and air and could increase the <br />danger of fire and endanger the public safety. <br />According to ihe City Code, all of the preceding criteria shall be satisfied in order to justify the <br />granting of a variance.
