Resolution 7903 <br /> Page 2 <br /> WHEREAS, according to Section 1125.02, Subdivision 2 of the Mounds View <br /> Municipal Code, the Planning Commission is to review a standard set of criteria, of which <br /> all must be satisfied, in order to grant a variance to the Zoning Code. <br /> WHEREAS, the purpose of the variance provision in the Zoning Code is to give <br /> relief to property owners when the strict enforcement of the code requirements imposes <br /> hardship thereby restricting the improvement of the property due to practical difficulties <br /> brought about by the unique or extraordinary features of the physical property that are <br /> beyond the property owner's control; and, <br /> NOW, THEREFORE, BE IT RESOLVED, that the Mounds View City Council does <br /> hearby uphold the decision of the Mounds View Planning Commission to deny Tim <br /> Downing, property owner of 8027 Woodlawn Drive, a variance to allow a detached garage <br /> to exceed the 18-foot accessory building height limit, incorporating herein by reference, the <br /> same findings of fact as stated in the Planning Commission's resolution of denial. <br /> Adopted this 12th day of March, 2012. <br /> .e .nl.
