It appears that the Administrative Director of the
Rice Creek Watershed District disagrees with the wetland
delineation map drawn by MSP/Westminster's consultant Ron Peterson.
It is Kate Drewary's position that the wetland must be moved in on
the site as much as 70 feet. The result of any such action would in
negatively impact the project's viability. Jeff Huggett informed me
that members of the RCW's Technical Panel will be meeting at the
site on Monday together with Ron Peterson, a certified soil
scientist from Ron's firm and MSP staff to determine the proper
delineation of the wetland. Members of the City staff will also be
in attendance.
It is Ron Peterson's professional determination that the existing
soils on the site do not indicate "hydric" soils and therefore
cannot be classified as wetland soils. Resolution of this matter is
imperative to the entire development process, including approval of
the Development Agreement for the TIF assistance.
Jeff Huggett will provide an update of this matter at the Work
Session on Monday nigh,t.
RC011TEND,TIOV:
, -
Sanantha Orduno; Executi're Director
