RESOLUTION NO. 4580 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION NO. 4580 REQUESTING THAT THE GOVERNMENTS OF THE STATE OF MINNESOTA AND THE UNITED STATES OF AMERICA CEASE AND DESIST FROM IMPOSING UNFUNDED MANDATES ON CITIES WHEREAS, the imposition of federal and state mandates onto cities continues to occur despite outcries from villages, townships, cities and hamlets across this nation; and WHEREAS, the ability of cities to maintain their economic viability is dependent on the suspension of unfunded state and federal mandates; and WHEREAS, the v. united States, simply commandeer states; and united States Supreme Court has ruled in New York 112 S. ct. 2408 (1992) that Congress may not the legislative and regulatory processes of the WHEREAS, many states, in reaction to more and more unfunded mandates, have declared "sovereignty under the 10th Amendment to the Constitution of the United States over all powers not enumerated and granted to the Federal government by the united States Constitution"; and WHEREAS, the State of Colorado has adopted a resolution which served "Notice and Demand to the federal government, as our agent, to cease and desist, effective immediately, mandates that are beyond the scope of its constitutionally delegated powers"; and WHEREAS, the City of Mounds View views unfunded federal mandates, as a violation of the constitution as well as a negation of its rights under due process. WHEREAS, the state mandates, like federal mandates, continue to put the cities of Minnesota at risk of financial instability and further limit a city's ability to serve its citizens. NOW, THEREFORE, BE IT RESOLVED THAT the City Council in and for the City of Mounds View, Minnesota supports the belief held by countless cities across the nation that until the. federal and state governments cease and desist from imposing costly, unfunded mandates on cities, the very survival of American cities is in serious jeopardy.
