<br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION NO. 5229 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION APPROVING A WETLAND BUFFER PERMIT FOR <br />THE ANTHONY PROPERTIES MANAGEMENTI O'NEIL PUD, <br />PLANNING CASE 517-98 <br /> <br />WHEREAS, Anthony Properties Management / O'Neil has requested approval of a <br />Wetland Buffer Permit for the property legally known as: <br /> <br />The Southwest 1/4 of the northwest 1/4 of Section 8, Township 30, Range 23, lying <br />southwesterly of State Trunk Highway No. 10-62, according to the United States <br />Government Survey thereof and situate in Ramsey County, Minnesota and all that <br />part of the northwest 1/4 of the northwest 1/4 of Section 8, Township 30, Range 23, <br />lying southwesterly of State Trunk Highway No. 10, according to the United States <br />Government Survey thereof and situate in Ramsey County, Minnesota <br /> <br />WHEREAS, the above-described property is zoned PUD, Planned Unit Development; <br /> <br />and, <br /> <br />WHEREAS, Section 1010.08 ofthe Municipal Code states that a Wetland Buffer Permit is <br />required when any construction activities are planned within one-hundred feet of a wetland; and, <br /> <br />WHEREAS, no development activities or disturbances of any kind will occur within the <br />wetland itself; and, <br /> <br />WHEREAS, the City Engineer has reviewed the final plans and has determined that the <br />extent of impervious encroachment into the buffer should not negatively impact the wetland; and, <br /> <br />WHEREAS, the quality of water infiltrated to the wetland will be enhanced by the two <br />NURP ponds and the strip of natural vegetation between the buildings and the wetland. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council <br />approves the Wetland Buffer Permit requested by Anthony Properties Management / O'Neil. <br />contingent upon the following: <br /> <br />1. <br /> <br />Plans and supporting documentation for controlling erosion shall be provided by <br />the applicant and approved by the Community Development Director prior to the <br />issuance of any grading or building permits. <br /> <br />2. The pervious surface areas of the lots shall be sodded or landscaped (up to the ten- <br />
