RESOLUTION 8021 <br /> CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION AUTHORIZING ABATEMENT OF NUISANCE CODE <br /> VIOLATIONS AT 8379 RED OAK DRIVE, MOUNDS VIEW, MINNESOTA, 55112. <br /> WHEREAS, Ann M. Moe is the owner of property located at 8379 Red Oak <br /> Drive, zoned R-1, Single Family Residential, legally described as follows: <br /> MOE HOMESTEAD ADDITION LOT 9 BLK 1 <br /> PIN# 06-30-23-12-0103 <br /> WHEREAS, on September 13, 2012, City staff observed junk, inoperable <br /> equipment, and other debris stored outside 8379 Red Oak Drive in violation of the City <br /> Nuisance Code and issued a notice of violation Ann M. Moe; and <br /> WHEREAS, there has been a persistent and repeated history of exterior <br /> Nuisance Code Violations at 8379 Red Oak Drive; and <br /> WHEREAS, on September 28, 2012 Ann Moe requested an extension to <br /> complete corrective action until after the City of Mounds View fall Clean up day on <br /> October 6, 2012; and <br /> WHEREAS, on November 9, 2012 City staff completed a reinspection at 8379 <br /> Red Oak Drive and observed remaining code violations; and <br /> WHEREAS, in a Notice dated November 16, 2012, City Staff notified Ann M. <br /> Moe of the intent to appear before the Mounds View City Council on November 26, <br /> 2012 to request authorization to abate the City Code violations cited in the September <br /> 13, 2012 Notice of Violation; and <br /> WHEREAS Ann M. Moe is responsible for correcting the Nuisance Code <br /> violations on the exterior of the above-said property that include, but are not limited to: <br /> 1. Exterior accumulation of old machinery, junk, automotive parts, rusting metal and <br /> inoperable/unusable equipment. <br /> WHEREAS, the City Council finds that the nuisance code violations at 8379 Red <br /> Oak Drive constitute a Public Nuisance under Sections 607.07 Subd. 2a. and 607.03 <br /> Subd. 3c and the City may abate and assess the costs of said abatement against the <br /> property pursuant to Minn. Stat. 429.101; and <br /> WHEREAS, the City has met the notification requirement for Nuisance <br /> Abatement as stated in 607.09, Subd. 5b. of the Mounds View Municipal Code; and <br />
