<br />RESOLUTION NO. 4431 <br /> <br />. <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION AMENDING THE JOINT POWERS AGREEMENT FOR CONSTRUCTION AND <br />OPERATION OF FIRE TRAINING SITE <br /> <br />WHEREAS, the parties of Fridley, Brooklyn Center, Spring Lake Park, <br />Blaine and Mounds View had entered into an agreement titled "Joint Powers <br />Agreement - Fire Training Association", a copy of which is attached hereto; <br />and <br /> <br />WHEREAS, the only expenditure of funds to date pursuant to said <br />agreement has been by the City of Fridley; and <br /> <br />WHEREAS, a party to the agreement, the city of Columbia Heights, has <br />given written notice to the other parties via letter dated August 10, 1992 <br />that it no longer wishes to participate in the agreement; and <br /> <br />WHEREAS, the remaining parties desire to amend said agreement in order <br />to continue the project of constructing and operating a fire training site. <br /> <br />NOW, THEREFORE, BE IT RESOLVED, the undersigned party agrees to the <br />following modifications of the agreement: <br /> <br />1. <br /> <br />Deletion of Columbia Heights: <br /> <br />. <br /> <br />Delete from the "Joint Powers Agreement - Fire Training <br />Association" (copy attached, and hereafter called the AGREEMENT), <br />the City of Columbia Heights, wherever that name appears, and <br />change the number of "member departments" from four to three <br />wherever stated. The undersigned hereby acknowledge receipt of a <br />termination notice from the City of Columbia Heights by letter <br />dated August 10, 1992 from its attorney Greggory J. Woods, and <br />accept the termination in accordance with paragraph 16 of the <br />AGREEMENT. There exists no claim against Columbia Heights for <br />proportionate share of initial construction costs or operating <br />costs. <br /> <br />2. <br /> <br />Initial Construction: <br /> <br />The "initial construction costs" identified in paragraph 6 of the <br />AGREEMENT shall be changed to $150,000, it being understood that <br />the parties may later increase this amount if additional <br />contributions are approved by the parties' respective governing <br />bodies. <br /> <br />3. Operating Budget: <br /> <br />The statement in paragraph 7 of the AGREEMENT citing the 1991 <br />Operating Budget is deleted. <br /> <br />. <br /> <br />4. <br /> <br />Amendment: <br /> <br />The AGREEMENT amendment procedure shall require unanimous <br />approval of the parties, in lieu of majority approval, reflecting <br />the existence of three rather than four parties. <br />
