<br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION NO. 4852 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION APPROVING WETLAND ALTERATION PERMIT REQUEST FOR <br />SHERRI RUF TO ALLOW CONSTRUCTION OF A SINGLE FAMILY HOME ON <br />PROPERTY LOCATED AT LOT 2, BLOCK 1 DOWNING ADDITION <br />PLANNING CASE NO. 401-94 <br /> <br />WHEREAS, the Mounds View City Council has reviewed the <br />request by Sherri Ruf for a wetland alteration permit to construct <br />a single family home on her property which is located in a wetland <br />zone; and <br /> <br />WHEREAS, the location of the home on the property meets <br />all setback requirements; and <br /> <br />WHEREAS, the Municipal Code allows construction in a <br />wetland zone with approval of Wetland Alteration Permit; and <br /> <br />WHEREAS, the City Consulting Engineer has reviewed the <br />request and determined that it meets the intent of the Municipal <br />Code and that there will be no adverse impacts on the wetland as a <br />result of the proposed structure and associated landscaping. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View City <br />Council approves the Wetland Alteration Permit request by Sherri <br />Ruf for the property legally known as Lot 2, Block 1 Downing <br />Addition contingent upon the following: <br /> <br />1. The applicant shall provide the City of Mounds View with <br />documentation from the Rice Creek Watershed District <br />indicating their approval/awareness of the project. <br /> <br />2. The applicant shall escrow funds, in an amount to be <br />determined by the City consulting Engineer, to ensure <br />that mitigation efforts on the site are satisfactorily <br />completed. <br /> <br />BE IT FURTHER RESOLVED that the Mayor and City <br />Administrator are authorized to execute a Development Agreement <br />with the applicant to ensure completion of the wetland mitigation. <br />
