<br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION NO. 4038 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION DENYING VARIANCE REQUEST BY JOHN ENGBERG, <br />3030 COUNTY ROAD J, TO ALLOW 1,644 SQUARE FEET OF <br />ACCESSORY BUILDING AREA WHERE ONLY 1,264 SQUARE <br />FEET IS ALLOWED BY MOUNDS VIEW MUNICIPAL CODE, <br />PLANNING CASE NO. 304-90 <br /> <br />WHEREAS, John Engberg, 3030 County Road J, has <br />requested a variance to allow 1,644 square feet of accessory <br />building area where only 1,264 is allowed by Code; and <br /> <br />WHEREAS, Chapter 40.26, Subd. D, of the Municipal Code <br />states the criteria which must be met for granting a variance; <br />and <br /> <br />WHEREAS, City Staff and Planning Commission have <br />reviewed the proposal; and <br /> <br />WHEREAS, the Mounds View Planning Commission has denied <br />the request for a variance; and <br /> <br />WHEREAS, it is the applicant's right to appeal the <br />Planning Commission's decision to the City Council; and <br /> <br />WHEREAS, the Mounds View City Council has reviewed the <br />variance request; and <br /> <br />WHEREAS, there are no existing extraordinary <br />circumstances as presented which apply to the property which <br />do not apply to other properties in the same zone; and <br /> <br />WHEREAS, the special conditions or circumstances result <br />from the actions of the applicant. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of <br />the City of Mounds View denies the request by John Engberg for <br />a variance to allow 1,644 square feet of accessory building <br />area where only 1,264 is allowed. <br /> <br />Adopted this 28th day of January, 1991. <br /> <br />ATTEST: <br /> <br /> <br /> <br />(SEAL) <br /> <br />~~ <br />Clerx- in--~~r <br />
