<br />. <br /> <br />. <br /> <br />. <br /> <br />c.... <br /> <br />"'" <br /> <br />RESOLUTION NO. 4039 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION DENYING REZONING REQUEST FOR 2865 HIGHWAY 10, <br />GREG JOHNSON, PLANNING CASE NO. 320-90 <br /> <br />WHEREAS, Mr. Greg Johnson has applied to rezone the <br />property located at 2865 Highway 10 from R-O, Residential- <br />Office District to B-3, Highway Business District; and <br /> <br />WHEREAS, Chapter 40.25, Subdivision A(5), provides <br />that the Planning Commission shall consider possible adverse <br />effects of the proposed amendment or conditional use. Its <br />judgement shall be based upon, but not limited to, the <br />following factors: <br /> <br />I. Relationship to Municipal Comprehensive Plan. <br /> <br />2. The geographical area involved. <br /> <br />3. <br /> <br />Whether such use will tend to or actually <br />depreciate the area in which it is proposed. <br /> <br />4. The character of the surrounding area. <br /> <br />5. The demonstrated need for such use. <br /> <br />WHEREAS, the rezoning request is inconsistent with <br />the City's Comprehensive Land Use Plan designation for this <br />property which is medium density residential; and <br /> <br />WHEREAS, a B-3 development on this property would be <br />directly adjacent to residential property on the north and <br />east; and <br /> <br />WHEREAS, the proposal has been submitted to the City <br />in order to allow the property owner to sell the property and <br />no development is currently before the Planning Commission or <br />City Council for their consideration; and <br /> <br />WHEREAS, the Mounds View Planning Commission has <br />reviewed the request and has recommended denial. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the City Council <br />of the City of Mounds View denies the rezoning request from <br />R-O to B-3 because of the following: <br /> <br />1. <br /> <br />The proposed zoning does not conform with the <br />Comprehensive Land Use Plan. <br />
