<br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION NO. 6522 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION APPROVING A ONE-YEAR EXTENSION OF THE REQUIREMENT <br />TO CONNECT 2310 COUNTY ROAD 10 TO MUNICIPAL WATER <br />AND SANITARY SEWER SERVICES <br /> <br />WHEREAS, the Mounds View Municipal Code requires that all properties having direct <br />access to municipal water and sanitary sewer be connected to such utilities; and, <br /> <br />WHEREAS, the property at 2310 County Road 10 has had access to said municipal <br />utilities since 1968; and, <br /> <br />WHEREAS, repeated attempts have been made to work with the property owner(s) to <br />effectuate the utility connections from 1968 to the present without success; and, <br /> <br />WHEREAS, 2310 County Road 10 remains the last occupied property in the City having <br />direct access to the utilities that is not connected to said utilities; and, <br /> <br />WHEREAS, the City Council recognizes that the potential exists for a redevelopment in this <br />area that would justify the extension of the connection requirement for a specified period of time. <br /> <br />NOW, THEREFORE BE IT RESOLVED, the City Council of the City of Mounds View <br />approves a one-year extension of the requirement to connect to the municipal water and sanitary <br />sewer services subject to the following condition: <br /> <br />1. The property owner shall remit to the City a cash surety in the amount of $15,000 <br />to cover the anticipated cost of the improvements. In the event the cost to connect <br />to the utilities exceeds the surety deposited with the City, the property owner shall <br />be liable for the difference. Any excess funds remaining after connection has been <br />made shall be returned to the property owner less any accumulated administrative <br />fees. The surety will not accrue interest. <br /> <br />2. If the cash surety is not received by May 31, 2005 and the connections have not <br />yet been made, the extension approved herein shall be voided and the City will <br />initiate and pursue all appropriate enforcement activity to achieve compliance with <br />the City Code. <br /> <br />NOW, THEREFORE BE IT FINALLY RESOLVED that the one-year extension shall <br />expire on May 1, 2006, after which time connection shall immediately be undertaken. <br /> <br />Adopted this 9th day of May, 2005. <br /> <br />,j!!i-l!lc~ <br />RObY06;: L~ <br /> <br />Kurt Ulrich, City Administrator <br /> <br />ATTEST: <br /> <br />(SEAL) <br />
