<br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION NO. 4941 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAt\1SEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION AUTHORIZING THE CLERK-ADMINlSTRATOR <br />TO EXECUTE THE OAK GROVE LANDFILL REIMBURSENfENT AGREENIENT <br /> <br />WHEREAS, the Oak Grove Landfill site is now in the Minnesota Landfill Clean-Up <br />Program; and <br /> <br />WHEREAS, the City of Mounds View is a member of the Oak Grove Trust and is eligible <br />for reimbursement from the State of Minnesota for Oak Grove Landfill Clean-up Costs; and <br /> <br />WHEREAS, a Reimbursement Agreement has been proposed to members of the Oak <br />Grove Trust to allow Trust members to receive reimbursement for funds expended pursuant to a <br />Consent Decree with the U. S. Justice Department regarding the Oak Grove Landfill Clean-up <br />Costs; and <br /> <br />WHEREAS, the City of Mounds View has made payments to the U. S. Department of <br />Justice under the Consent Decree; and <br /> <br />WHEREAS, the Landfill Clean-Up Agreement was executed by the State of Minnesota on <br />March 5, 1996; and <br /> <br />WHEREAS, the Reimbursement Agreement has been proposed to resolve existing legal <br />disputes and liability regarding the environmental response cost for the Oak Grove Landfill; and <br /> <br />wHEREAS, the Mounds View City Attorney has reviewed the proposed Reimbursement <br />Agreement and has recommended its approval by the City Council and execution by the Clerk- <br />Administrator. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the City Council in and for the City of <br />Mounds View hereby approves the Reimbursement Agreement and authorizes the Clerk- <br />Administrator to execute the Reimbursement Agreement and provide any documentation to make <br />the City eligible for reimbursement of funds pursuant to the Reimbursement Agreement.. <br /> <br />Adopted this 22nd day of April, 1996. <br /> <br />ATTEST: <br /> <br />F( <br />. ?~~ <br /> <br />.
