<br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION NO. 5974 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION UPHOLDING THE PLANNING COMMISSION DENIAL OF A <br />VARIANCE FROM THE MINIMUM PARKING REQUIREMENT FOR A PROPOSED <br />MULTIPLE DWELLING EXPANSION AT 2075 HILLVIEW ROAD; <br />PLANNING CASE NO. VR03-001 <br /> <br />WHEREAS, the applicants Thuy Thi Sui and Jamey Viger applied for a variance <br />from the minimum parking requirement for a multiple-family dwelling; and, <br /> <br />WHEREAS, the applicant is proposing to expand the existing four-unit dwelling to <br />a six-unit dwelling; and <br /> <br />WHEREAS, the property is zoned R-3, Medium Density Residential, which <br />allows a six-unit dwelling; and <br /> <br />WHEREAS, the City Code requires 1.5 parking spaces per unit plus 1 garage <br />space per unit; and, <br /> <br />WHEREAS, the property currently has 12 parking spaces, of which only 2 are <br />garage spaces; and, <br /> <br />WHEREAS, according to Section 1125.02, Subdivision 2 of the Mounds View <br />Municipal Code, the Planning Commission is to review a standard set of criteria, of <br />which all must be satisfied, in order to grant a variance to the Zoning Code. <br /> <br />WHEREAS, on February 5, 2003, the Planning Commission held a public <br />hearing, accepted testimony and reviewed the facts associated with the request; and, <br /> <br />WHEREAS, on February 19, 2003, the Planning Commission adopted <br />Resolution 719-03, a resolution DENYING the requested variance; and, <br /> <br />WHEREAS, on March 2, 2003, the applicants formally appealed the Planning <br />Commission's denial to the Mounds View City Council requesting approval of the <br />variance; and, <br /> <br />WHEREAS, prior to the public hearing, the applicants indicated they were no <br />longer interested in pursuing the variance appeal; and, <br /> <br />WHEREAS, the Mounds View City Council held the scheduled public hearing <br />regarding the appeal on March 24, 2003, taking testimony from the staff, the applicants <br />and general public. <br />
