Cre�rers: <br />We have reviewed your proposal dated January ii. 7979, and found it to be <br />totally unacceptable. It appears that your firm is unw117ing to negotiate <br />and discuss this issue in a professional and reatistic :vein, <br />The facts of the situation are very ciear: <br />1. The City presently�owns 16.5 acres of prime buildable property at <br />the intersection of County Road li-2 and Sitver Lake Road. <br />2. The developer is required by City Ordinance (Chapter 42, Subdivision <br />1) to dedicata tG%.-cash-ar.laod.� zquSvalent at the time of subdivision. <br />It should also be noted that this ordinance does not allow the City to <br />consider "storm water holding areas or ponds, whether required by the <br />Municipali*y or any other regutatory Dody" as a portion of the required <br />dedi cati on. <br />3. The Lity has obtained a State and Federal L.A.W.C.O.N. 9rant for the <br />acquisition of land for Sitver View Park. <br />4. The City requires by ordinance (Chapter 4C;04, Subdivision E) that the <br />developer must su4mit a copy of the final dralnage plans for the proposed <br />derelopr,ient to be approved by the City Engineer. In addition "a11 <br />drainage plans shall conform to the comprehensive storm drainage plan of <br />the Flunicipality". <br />
