' � . <br />i"� <br />ORDINANCE N0. 78-II <br />At7 EIdERGENCY ORD:PAIlCf AI4EtlDI�lG THE RQ:;CIPlDSALE LODE OF <br />UkDIt1ANCES TO REGULATL" THE USES LP N11R1:5 <br />Preamble <br />WHEREAS, the City Louncil of the City of Robbinsdale in council assembled <br />has deternined the existing park use ordinance does nat control the problems <br />associated �iith the use of alcoholic beverages on park premises and <br />WHEREAS, a threat to the health, repose, safety and general welfare of <br />the public is created by the use and zbuse of alcoholic beverages viithin parks <br />and <br />WHEREAS, tY�e C�ty Ccunr.i7 or the �ity of Rotbinsdale has detar�iined that <br />an energencv exists as to the use of atcohoiic beverag?s on park premises and <br />that an ordinance is necessary for immediate preservation of public peace and <br />safety. - <br />NOW THEREFORE, this ordinance is declared an emergency ordinance and therefore <br />The City of Robbinsdale orda�ns: <br />Section i. Present Ordinance Sections 75-201 and 15-202 are repealed <br />in their entirety. • <br />Section 2. Section 15-201 and Section 75-202, Robbinsdate Code of <br />Ordinances, shall hereafter be as foliows: <br />Se[tion IS-201 <br />Subd. 1. Definitions. For the purposes of this ordinance the following de- <br />finitions shall apply: <br />A. Parks - any arez x�her:ver located which i� reserved, desianated <br />or used for active or passiv> recreation and which is o�•med, <br />operated or �ontrotled by the City or rrhich is located within <br />the City but owned, operated or cuntrolled by another goverinnental <br />unit. <br />B. Person - any individual, firni, partnership, association, corporation, <br />company or organization of any kind. <br />C. "Intoricating Liquor" - any distilled, fcrmented or vinous beverage <br />eontaSning more than three and two-tenths percent of alcohot <br />by weight. <br />D. "Non-intoxicatin9 Malt Liquor" nr "Ocer" - any malt beverage with <br />an aleoholic content of ciorr than one-half of' one p@rcent by <br />'volume and not more Lhan thrcc und L��tU-ttnlh, percent��tiy wr.ight. � <br />Subd. 2.
