<br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION NO. 6232 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />SETTING AN ASSESSMENT HEARING DATE OF MAY 24, 2004, AUTHORIZING <br />THE ADVERTISEMENT FOR THE ASSESSMENT HEARING, DECLARING COST TO <br />BE ASSESSED, AND ORDERING THE PREPARATION OF THE PROPOSED <br />ASSESSMENT FOR THE 2003 STREET IMPROVEMENT PROJECT <br /> <br />WHEREAS, On March 22, 2004, City Council approved the plans and <br />specifications, authorized to advertise for bids, established a Bid Date of April 22, 2004, <br />approved and authorized the execution of a Joint Powers Agreement with the City of <br />Spring Lake Park, and authorized the acquisition of easements (if necessary) for the <br />2003 Street Improvement Project; and <br /> <br />WHEREAS, bids for this project were received on April 22, 2004; and <br /> <br />WHEREAS, as per State Statute Chapter 429.061, at any time after the expense <br />have been or will be incurred, the City shall calculate said expense under the direction <br />of the City Council when making an improvement. Furthermore, the City Council shall <br />determine, by resolution, the amount of the total expense the municipality will pay, not <br />including the amount it will pay as the owner of property in the project area, and the <br />amount to be assessed, and <br /> <br />WHEREAS, the City, with the assistance of the consulting engineer, is required <br />to calculate the proper amount to be specially assessed for such improvement against <br />every assessable lot, piece or parcel of land within the district affected, without regard to <br />cash valuation, as provided by law, and shall file a copy of such proposed assessment <br />at City Hall for public inspection. <br /> <br />WHEREAS, May 24, 2004, 7:00 p.m. assessment hearing date will provide <br />ample time to prepare an assessment role, publish an advertisement for the <br />assessment hearing, and provide the required mailing to notify property owners which <br />might be affected, as per state statute; and <br /> <br />WHEREAS, per state statute, the City shall publish notification in the newspaper <br />at least once and shall mail notification to the owner of each parcel described in the <br />assessmentrole. The owners are defined as those shown to be such on the records of <br />the County Auditor. Such publication and mailing shall be sent no less than two weeks <br />prior to such a meeting of the City Council; and <br /> <br />WHEREAS, a feasibility report has been completed and estimated costs have <br />been determined for the 2003 Street Improvement Project; and <br />
