PUD Amendment Report <br /> Building N <br /> April 12, 2004 <br /> Page 7 <br /> • MOUNDS VIEW PLANNING COMMISSION <br /> RESOLUTION 753-04 <br /> CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION RECOMMENDING APPROVAL OF AN AMENDMENT TO THE <br /> MOUNDS VIEW BUSINESS PARK EAST PUD BY ADDING "RELIGIOUS <br /> INSTITUITION" AS AN ALLOWED USE ON LOT 1, BLOCK 1, MOUNDS VIEW <br /> BUSINESS PARK EAST 2ND ADDITION; <br /> MOUNDS VIEW PLANNING CASE PA04-001 <br /> WHEREAS, the Mounds View City Council approved the Mounds View Business <br /> Park East Planned Unit Development (PUD) on October 24, 1994; and, <br /> WHEREAS, the lot located at 5145 Program Avenue, legally described as Lot 1, <br /> Block 1; Mounds View Business Park East 2nd Addition,was approved by the Council for a <br /> 40 office/industrial/flex use; and, <br /> WHEREAS, having been unable to lease the building with an office or industrial <br /> business, the developer wishes to amend the PUD Agreement by adding "religious <br /> institution" as an allowed use for the site; and, <br /> WHEREAS, the Planning Commission has reviewed this request and has examined <br /> the potential adverse effects that could result from such an amendment. <br /> NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning <br /> Commission makes the following finding of fact related to this request: <br /> 1. The lot in question, 5145 Program Avenue, is zoned Planned Unit Development <br /> (PUD) and the allowed use for the site is office/flex. <br /> 2. The building in question remains vacant and as such the developer has requested <br /> an amendment to the PUD to allow for a church to occupy the site. <br /> 3. The proposed use should not create an excessive burden on any public facilities or <br /> utilities that serve the area. <br /> 4. The property is bordered to the north and west by industrial/business uses. To the <br /> south and east is Program Avenue. The change of use should have no <br /> • depreciatory affects upon this area. <br /> 5. The appearance of the structure will not have an adverse effect on the PUD in that <br /> the exterior of the building would receive only slight modification. <br />
