DRAFT <br /> 4.15.2004 <br /> • <br /> EXHIBIT E <br /> HIDDEN HOLLOW <br /> DEVELOPERS AGREEMENT <br /> THIS AGREEMENT is made this day of , 2004,by and between <br /> the CITY OF MOUNDS VIEW, a Minnesota municipal corporation, the "City", and Pro Craft <br /> Development, LLC, a limited liability company under the laws of the State of Minnesota (the <br /> "Developer"). <br /> Recitals <br /> A. The Developer is the fee owner of certain real estate located in Ramsey County, <br /> Minnesota,legally described as <br /> (See EXHIBIT A) <br /> (hereinafter referred to as the "Property"). <br /> • B. The Developer shall plat the Property consistent with the preliminary plat of <br /> HIDDEN HOLLOW approved by the City Council in Resolution No. on <br /> , 2004, subject to the conditions and requirements contained in the <br /> authorizing resolution, the Mounds View City Code and state statutes. <br /> C. The Developer desires to have certain public improvements constructed to serve the <br /> Property as described in Exhibit B attached hereto and hereby made a part hereof (hereinafter <br /> referred to as the"Improvements"). <br /> D. The Developer will cause the construction of certain building site preparation, <br /> grading, drainage, etc. improvements to serve the Property as described in Exhibit D attached hereto <br /> and hereby made a part hereof(hereinafter referred to as the"Site Preparation"). <br /> E. The Developer wishes the City to construct the Improvements without notice of <br /> hearing or hearing on the Improvements, and without notice of hearing or hearing on the special <br /> assessments levied to fmance the Improvements, and to levy 100 percent of the cost of the <br /> Improvements against the Property. <br /> F. The City is willing to construct the Improvements in accordance with the request of <br /> the Developer and without such notices or hearings, provided the assurances and covenants <br /> hereinafter stated are made by the Developer to ensure that the City will have valid and collectable <br /> 0 special assessments as they relate to the Property to fmance all of the costs of the Improvements. <br /> SJR-245249v4 <br /> MU205-29 <br /> E-1 <br />
