<br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION NO. 5627 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />A RESOLUTION APPROVING A DEVELOPMENT REVIEW FOR AN EXPANDED <br />BILLBOARD AT 2373 HIGHWAY 10, REQUESTED BY CLEAR CHANNEL OUTDOOR; <br />PLANNING CASE NO. DE01-004. <br /> <br />WHEREAS, Chris McCarver, representing the applicant Clear Channel Outdoor, <br />has requested a development review to allow for an expansion of the existing billboard <br />on Community Center open space, 2373 County Highway 10 as shown on the attached <br />Exhibit A; and, <br /> <br />WHEREAS, the existing billboard is approximately 25 feet tall and 300 square feet <br />in area, and is located on a perpetual easement owned by the applicant; and, <br /> <br />WHEREAS, the applicant is requesting to expand the existing billboard area to <br />672 square feet (14 feet tall by 48 feet long) at the same 25-foot height; and, <br /> <br />WHEREAS, the subject property is zoned PUD, Planned Unit Development, and <br />the billboard is considered a legal, nonconforming sign, and; <br /> <br />WHEREAS, according to Section 1008.13, Subd. 1. of the Sign Code, "Structural <br />alterations, enlargement or re-erection are permissible only where such alterations would <br />not increase the degree of the nonconformity of the sign;" and, <br /> <br />WHEREAS, expansion of the sign is permissible because the alteration does not <br />increase the degree of nonconformity; and, <br /> <br />WHEREAS, according to Chapter 1006.06 of the Mounds View Municipal Code, <br />any new construction or expansion of existing facilities or uses requires the approval of a <br />development review; and, <br /> <br />WHEREAS, the City Council has reviewed the following documents regarding <br />this proposal: <br /> <br />a. Planning Application <br />b. Zoning Map <br />c. Site Plan with Landscape Features <br />d. Billboard Elevation <br />e. Extract of Planning Commission Minutes, 9/19/2001 <br />f. Planning Commission Resolution 673-01 <br />g. Easement Purchase Agreement <br />h. Staff Report <br /> <br />WHEREAS, the proposed development satisfies the requirements of the Zoning <br />Code and building code; and, <br />
