<br />. <br /> <br />. <br /> <br />. <br /> <br />Resolution 5641 <br />Page 2 <br /> <br />WHEREAS, the Planning Commission revic\ved this request on October 17, <br />2001, and rccommended approval ofthc preliminary plat; and, <br /> <br />and, <br /> <br />WHEREAS, the City Council held a Public Hearing on November 13,2001; <br /> <br />NOW, THEREFORE, BE IT RESOLVED that thc Mounds Vicw City Council approves <br />the preliminary plat ofthc Gustafson's Fifth Addition major subdivision, subject to the following <br />stipulations: <br /> <br />I, Prior to the City Council approving this subdivision, the applicant shall submit the <br />required park dedication fee in the amount 01'$5,590. <br /> <br />2. The applicant shall be responsible for obtaining an access pennit fi"om Ramsey County <br />for any and all work oCClLn"ing within the County right o1'\vay. <br /> <br />3. The applicant shall apply tor Final Plat approval within six (6) months or the <br />Preliminary Plat approval will expirc. <br /> <br />4. An access permit for driveways on proposed Lots #5 and #6 from St. Paul Water <br />Works is necessary. <br /> <br />5. A dcvelopment contract which sets f011h all of the tenl1S, conditions, requirements, <br />agrcements, guarantecs and plans for the orderly development of said land shall be <br />entcred into between the developer and the Municipality prior to the final approval of <br />this subdivision <br /> <br />6. Deed restrictions shall be rccorded with the property for Lots #5 and #6 to include the <br />following: <br /> <br />a. If one dwelling unit is burned or destroyed, it shall be reconstructed in a uniform <br />appearance. <br /> <br />b. (fboth dwelling units are burned or destroyed, minimum lot widths shall then prevail as <br />for single-family homes. <br /> <br />c. ^ double dwelling unit may be rebuilt meeting the original conditions of this Title. <br /> <br />d. A uniform extcrior appearance, in terms of color, design and maintenance shall be <br />maintained. <br /> <br />Adoptcd this 13th day of November, 200 I. <br />
