<br />. <br /> <br />. <br /> <br />. <br /> <br />Resolution 56-l1 <br />Page 2 <br /> <br />WHEREAS. the Planning Commission reviewed this request on October] 7, <br />2001. and rccommended approval of the preliminary plat; and, <br /> <br />WHEREAS, the City Council held a Public Hearing on November 13, 200]; <br /> <br />and. <br /> <br />?\OW, THEREFORE, BE IT RESOLVED that the Mounds View City Council approves <br />the preliminary plat of the Gustafson's Fifth Addition major subdivision, subject to the 10110wing <br />stipulations: <br /> <br />I. Prior to the City Council approving this subdivision, the applicant shall submit the <br />required park dedication fee in the amount of55,590. <br /> <br />") The applicant shall be responsible fix obtaining an access permit from Ramsey County <br />for any and all work occurring within the County right of way. <br /> <br />3, The applicant shall apply for Final Plat approval within six (6) months or the <br />Preliminary Plat approval will expire, <br /> <br />4. An access pcnnit tor driveways on proposed Lots #5 and #6 from St. Paul Water <br />\-Vorks is necessary. <br /> <br />5. A development contract which sets f011h all of the terms, conditions, requirements, <br />ab'reements, guarantees and plans for the orderly developmcnt of said land shall be <br />entered into between the developcr and the Municipality prior to the final approval of <br />this subdivision <br /> <br />6. Deed restrictions shall be recorded with the property for Lots #5 and #() to include the <br />Collowing: <br /> <br />a. If onc d\velling unit is bumed or destroyed, it shall be reconstructed in a uniform <br />appearance. <br /> <br />b. J fboth dwelling units are burned or destroyed, minimum lot \vidths shall then prevail as <br />for single-family homes. <br /> <br />c. A double dwelling unit may be rebuilt mceting the original conditions of this Title. <br /> <br />d.
