<br />. <br /> <br />. <br /> <br />. <br /> <br />Resolution 5650 <br />Page 2 <br /> <br />WHEREAS, in accordance with Section 1204.04, Subd. 4, a park dedication fee in the <br />amount of $5,590 is applicable with this proposed major subdivision; and, <br /> <br />WHEREAS, the Planning Commission reviewed the preliminary plat on October <br />17,2001, and recommended approval; and, <br /> <br />WHEREAS, the City Council held a Public Hearing on November 13, 2001; <br /> <br />and, <br /> <br />WHEREAS, the City Council approved the preliminary plat on 1'\ovember 13, <br /> <br />2001. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View City COllncil approves <br />the final plat of the Gustafson's Fifth Addition major subdivision, subject to the following <br />stipulations: <br /> <br />1. Prior to the recording the subdivision with Ramsey County, the applicant shall submit <br />the required park dedication fee in the amount of $5,590. <br /> <br />2. The applicant shall be responsible for obtaining an access penl1it from Ramsey County <br />tor any and all work OCCUlTing within the County right of way. <br /> <br />4. An access permit for driveways on proposed Lots #5 and #6 from St. Paul Water <br />Works is necessary. <br /> <br />5. A development contract which sets forth all of the terms, conditions, requirements, <br />agreements, guarantees and plans lor the orderly development of said land shall be <br />entered into betwecn the developer and the Municipality within sixty (60) days of final <br />approval. <br /> <br />6. Deed restrictions shall be recorded with the propeliy for Lots #5 and #6 to include the <br />following: <br /> <br />a. If onc dwelling unit is burned or destroyed, it shall be reconstructed in a unitorm <br />appearance. <br /> <br />b. Ifboth dwelling units are burned or destroyed, minimum lot widths shall then prevail as <br />for single-family homes. <br /> <br />c. A double dwelling unit may be rebuilt meeting the original conditions of this Title. <br /> <br />d. A uniform exterior appearance, in terms of color, design and maintenance shall be <br />maintained. <br />
